As part of our membership in the Email Sender and Provider Coalition, we receive exclusive updates on newly crafted email legislation globally as well updates on new state laws surrounding online privacy. If you aren’t already a member with ESPC, I would strongly recommend joining to stay in the know regarding email legislation and trends in the interactive marketing industry. Even if you are not currently a member the ESPC has some really great resources for marketers along with a test for compliance for emails.
Here are some recent updates in state email and privacy bills, of which we were notified by the ESPC:
Washington is proposing a bill concerning unsolicited goods and the promotional advertising of prizes, which relates to email sent of received by individuals in Washington.
Georgia has introduced a bill that would make it a crime to falsify headers, use a protected computer of another to relay commercial email, or use false information to register for email accounts. The provision allows for civil and criminal liability for offenders.
Missouri and Mississippi have introduced data breach notification laws.
Massachusetts has extended the deadline for businesses to comply with their new Identity Theft Regulations.
Virginia passed a bill which makes it a misdemeanor for a person who uses a computer network to falsify email transmission or routing information associated with unsolicited commercial email.
